Terms & Conditions

1. Overview

MER Notary Services provides professional remote online notarization (RON) services to clients within the United States and abroad in accordance with Virginia law.

 

These Terms & Conditions (“Terms”) govern all services provided by MER Notary Services and are intended to protect both the client and the notary. By scheduling an appointment, submitting payment, or using MER Notary Services, you agree to comply with these Terms and the Cancelation & Refund Policy.

2. Service Scope

Services include the preparation, hosting, and completion of electronic notarizations through MISMO-compliant remote platforms.

 

All remote online notarizations (“RON”) are conducted on MISMO-compliant platforms.

Sessions are audio-visually recorded in accordance with Virginia notarial law.

Completed notarized documents are digitally signed and electronically sealed (“document lock”), preventing further alteration after completion.

 

MER Notary Services reserves the right to decline any notarization that violates Virginia law, involves incomplete documents, or presents ethical or identity concerns.

3. Client Responsibilities

3.1 Identification and Readiness

Clients are responsible for ensuring that:

  • All signers must present one of the following valid, government-issued photo identifications:

    • U.S. driver’s license or state identification card

    • U.S. passport or passport card

    • U.S. permanent resident card

    • Foreign passport

  • Each signer can communicate in English or through an approved interpreter arranged in advance.

  • All documents are complete, accurate, and ready for notarization before the appointment.

  • The signing environment is quiet, well-lit, and free from distractions or outside assistance.

 

The notary may terminate the session immediately if outside assistance, coaching, or unauthorized prompting is observed. Termination under these circumstances does not qualify for a refund. Any fees associated with the session setup, preparation, interpreter coordination, or other scheduled services remain due as outlined in the Cancelation & Refund Policy

3.2 Technical Requirements

Clients must ensure that all signers have:

  • A compatible device (desktop, laptop, tablet) with camera and microphone access,

  • A stable internet connection, and

  • Browser compatibility with the assigned RON platform.

 

MER Notary Services provides detailed setup instructions before each appointment. If a session cannot be completed due to client-side technical issues, cancellation fees may apply.

4. Payment Terms

4.1 Estimates and Quote Approval

Clients must submit documents for review before a notarization appointment is confirmed.

After reviewing the documents, MER Notary Services will provide an estimate based on:

  • Document type

  • Number of notarizations required

  • Number of signers participating in the session

  • Any additional services such as interpreters, witnesses, or biometric identity verification

The notarization session will only proceed once the client confirms approval of the estimate.

4.2 Payment Timing

  • Payment is due upon completion of the notarization session.

  • After the session is completed, an invoice will be issued to the client.

  • Completed notarized documents will not be released until full payment has been received and verified.

4.3 Business Clients

  • Approved business clients may receive invoice terms.

  • Payment terms will be listed on the invoice and may include NET 15 or NET 30 depending on the client relationship.

 

Accepted payment methods include:

  • Credit or debit card

  • ACH bank transfer

  • Check (business clients only)

  • International wire transfer when applicable

4.4 Additional Service Fees

  • Interpreter coordination, witness services, rush scheduling, extended session time, or other additional services may incur additional fees.

  • These fees will be disclosed in the estimate before the notarization session and become payable once the service is scheduled or performed.

5. Cancellations and Refunds

5.1 Policy Reference

All cancellations, reschedules, refunds, and non-refundable conditions are governed by the Cancelation & Refund Policy.

 

By booking or participating in an appointment, you acknowledge that you have reviewed and agreed to both this document and the Cancelation & Refund Policy.

 

5.2 Service Completion Definition

 

A service is considered fulfilled once the notarial act has been performed or a notarization session has been conducted in good faith. This includes identity verification, session setup, interpreter coordination, document preparation, and time reserved for the scheduled appointment.

 

5.3 Refund Processing

 

Approved refunds are processed within 10 business days using the same payment method originally provided. Refund eligibility, method, and credit expiration timelines are outlined in the Cancelation & Refund Policy.

 

6. Chargebacks and Payment Disputes


Unauthorized chargebacks, payment reversals, or failure to pay a valid invoice after a completed or attempted notarization session are treated as payment defaults.
 

MER Notary Services reserves the right to:

  • Pursue legal collection,

  • Recover attorney’s fees, court costs, and related expenses, and

  • Report fraudulent disputes to payment processors or law enforcement, when applicable.

 

Clients are encouraged to contact MER Notary Services first with any billing concerns.

7. Dispute Resolution

 

7.1 Good Faith Resolution

Before initiating any formal dispute, both parties agree to make a good-faith effort to resolve the issue through direct communication. Most concerns can be resolved quickly with a respectful phone call or written correspondence.

 

7.2 Optional Arbitration

 

If a dispute cannot be resolved through communication, both parties may mutually agree to pursue binding arbitration under the rules of the American Arbitration Association (AAA) or another agreed-upon forum.

 

Arbitration is optional and may only proceed if both parties consent in writing after attempting good-faith resolution.

 

7.3 Court Action for Nonpayment or Collection

 

MER Notary Services reserves the unrestricted right to pursue payment-related disputes in Virginia courts, including the collection of unpaid invoices, chargebacks, and associated costs.

 

8. Limitation of Liability

 

MER Notary Services is not responsible for:

  • Rejections of notarized documents by third parties (such as lenders, agencies, or recorders),

  • Losses caused by client error, incomplete forms, or misinformation,

  • Technical failures caused by client devices, internet, or browsers, or

  • Any indirect, incidental, or consequential damages arising from the use of these services.

 

Liability is limited to the amount paid for the specific notarization session in dispute.

 

9. Confidentiality and Recordkeeping

 

All notarizations are conducted in compliance with Virginia law and platform security standards.

 

Recordings, identity verification logs, and electronic journals are maintained securely for the duration required by state regulation and may be accessed only by lawful request.

 

10. Governing Law

 

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to conflict of law principles.

 

11. Integration Clause

 

This Terms & Conditions document and the Cancelation & Refund Policy together represent the complete agreement between MER Notary Services and the client.

 

In the event of a conflict between the two documents, the policy governing the specific service or transaction shall prevail.

 

No modification or waiver of these Terms is valid unless made in writing and signed by both parties.
